Standard business conditions

1. Contracting party and conclusion of contract

Your contracting party is Gothic Noblesse, owner Kristin Müller, Heinrich-Hertz-Straße 5, 98693 Ilmenau, Germany. We accept contracts with private consumers. We also accept contracts with business consumers who, in the course of their work, use the products purchased from us with free benefits for the business consumer. Reselling the goods is not permitted. A private consumer is every natural person who negotiates a transaction for a purpose which can be assigned to neither a commercial nor a self-employed activity. The contracting language is German for customers from Germany and English for customers from EU-countries.

 

With customers less than 18 years we catch up the permission of the parents before the final contract.

 

The illustration of the products in the online-shop isn`t a lawful binding offer, but an invitation to order. Mistakes reserved. By clicking the order button in the last step of the ordering process you emit a binding order of the products which are listed on the ordering site. The entry of an order will be affirmed by an e-mail. This is only for the information that your order is received. The contract comes about with the delivery of the products and achieves its activity by your acceptance from receipt of the products, but at the latest after the end of the 14-days deadline for returning goods.

 

2. Return instruction

   

Right of withdrawal

   

The customer is entitled to withdraw the contract within 14 days without giving any reason for doing so.

The deadline for withdrawal is 14 days from the date on which the customer or a third party named by the customer, who is not the carrier, takes possession of the final goods delivered.

of the decision to withdraw from the contract in a clear declaration (e.g. by sending a letter by mail, fax or e-mail). The customer may use the withdrawal form template attached for this purpose, however, this is not obligatory. If you send back the goods, this is also valid as an explicit explanation of the withdrawal, unless you explain the return for other reason takes place at the same time.

For keeping the withdrawal deadline it is sufficient to send the declaration about the the exercise of the right of withdrawal or the goods before expiry of the deadline.

 

Consequences of withdrawal

 

If the customer withdraws from the contract, me must reimburse any payments we have received from the customer, including the delivery costs (excluding additional costs incurred if the customer has selected a different type of delivery to the cheapest standard delivery option offered by us) without delay, but not later than 14 days after the day on which we receive the notice of the customer`s withdrawal from this contract. We will use the same payment method the customer used for the original transaction in order to provide the reimbursement, unless otherwise expessly agreed, under no circumstances will the customer be charged a fee for this refund. We may withhold the reimbursement until we hve received the returned goods or until the customer has provided a proof that the goods are returned, whichever is earlier.

The customer must return or hand over the goods to us without delay and no later than 14 days from the date on which the customer notifies us of withdrawal from this contract. The return has to be sent to

The deadline is protected if the customer sends the goods before the expiry of the 14 day deadline.

Goods which are not transportable as a parcel we pick up with you.

We shall bear the costs of returning the goods (up to EUR 6,99 within Germany, up to EUR 16,99 in the EU-countries). The customer shall only be liable for any diminished value of the goods if this loss in value is attributable to any use or handling of the goods which is not deemed necessary in order to verify the condition, features and functioning of the goods.

3. Prices, forwarding costs and methods of payment

All prices are Euro-prices including the lawful value added tax of 19 % (except in the case of gift certificates and books). The prices at the moment of the order are counting.

For deliveries within Germany the all-inclusive price for the forwarding costs is standard EUR 5,95 per order, as long as nothing else is declared. For deliveries to the following named EU-countries the all-inclusive price for the forwarding costs is standard EUR 15,00 per order (click "German Post (EU)" as method of transport), as long as nothing else is declared.

We deliver to the following EU-countries and please not to order from other countries or the named limitations: Belgium, Bulgaria, Denmark (except Faroe Islands, Greenland), Estonia, Finland (except Åland Islands), France (except oversea areas and departments), Greece (except Mount Athos), Ireland, Italy (except Livigno, Campione d`Italia), Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands (except other than european areas), Austria, Poland, Portugal, Romania, Sweden, Slovakia, Slovenia, Spain (except Canary Islands, Ceuta, Melilla), Czech Republic, Hungary and Cyprus (except in the northern part).

At the moment the payment can be done by prepayment.

4. Delivery

Deliveries are in principle only possible within Germany and to the named EU-countries. The delivery is carried out by DHL. Deliveries will be executed as promptly as possible.

5. Reservation of proprietary rights

The delivered goods stay in the property of Gothic Noblesse until they are paid completely.

6. Guarantee

The right to revoke your orders doesn`t touch your right as a buyer in the meaning of the guarantee appointments by law.

7. Applicable law, copy right for pictures and disclaimer

For all deliveries German law is valid. The business location of Gothic Noblesse, 98693 Ilmenau, Germany is the place of jurisdiction in principle. In circumstance the law at the domicile of the end consumer may be applicable.

All copy rights for pictures stay at Gothic Noblesse or at the offered brands. A usage without explicit agreement is not allowed.

If Gothic Noblesse refers to other sites in the internet via links the following applies: Gothic Noblesse has no influence on the design and the contents of the linked sites and doesn`t adopt these contents as its own.

8. Final clauses

If single clauses are invalid or become invalid another legal arrangement that is nearest to them is coming into effect. The validity of all other clauses stays unaffected by this.
